My Mother tested 18 on a competent test. 15 is incompetent. My sisters the Trustees are saying they can do nothing about her still driving or living alone. My mother has lost 10 pounds since my last visit last year and now weighs 90 pounds. She has been more confused and her memory is getting worse. She just got back from Vegas where security had to call my sister who was in California because she didn't know where she was and forgot that she was with my Cousin. I flew to Vegas to get her and she asked me every morning where she was. She has good moments and then really confusing moments. I personally thought she should stop driving a year ago but the Trustees say because there is nothing they can do and because nothing has happened they cannot do anything. I am not a Trustess and have no power what should I do? This woman should not be on the road with her memory. Another thing is my Mother keeps accusing me of taking her Trust papers which I didn't. I saw the trust papers my last visit. Since then my 2 sisters have been to visit twice. Even in my mother's state she always puts things in the same place. There are no trust papers anywhere. It is my understanding that anytime my Mother makes changes she is suppose to get a copy and I know my sisters since my last visit made changes such as making themselves co-trustees and some other changes which my mother doesn't remember and my sisters won't tell me. I have asked my sister about this and she won't respond saying that everything is fair. Do I have a right to take my mother to the trust attorney and ask for a copy?

Of course if she lives in a different state, go to the DMV website for the state that issued her driver license.

kalolla - do yourself, your Mom, and other people on the road a big favor and take the keys to the car away from Mom - NOW. Do not wait for your non-helpful sisters to step in, do not wait for the DMV to send paperwork. Any person that had to be retrieved from anywhere by an adult child due to being "lost" has no business behind the wheel of a vehicle. She could get seriously lost or (God forbid) kill herself or some innocent person.

Driving is a privilege - not a right - you've got more evidence that something bad will happen if she's piloting a 6,000 lb machine....than confidence that it will be alright. If she balks,,,call her doctor and have her license taken away and store the car elsewhere (or sell it if you have title) - UNTIL MOM CAN MEET THE COMPETENCY REQUIREMENTS OF THE DMV.

Once that potential danger is set aside, then you can start looking at whether or not Mom can manage on her own or needs visiting or live-in nurses or assisted living care. Circumvent the sisters. Talk to your Mom's doctor.

Trustees only control the trust. They cannot stop her from driving. But the state of Nevada can. Go to their DMV website and print out the driver evaluation request, form DLD-23A. Let them decide.

There is a great deal of danger with your mother still driving. PLEASE take the keys away, hide them - whatever it takes - We did not wait to talk with anyone when we were in a similar situation. Now we can sleep better knowing he will not injure or kill someone.
