My mother is on Medicaid and in a nursing home; my father was not (on Medicaid or in a nursing home) he died last month and has a 5,000 insurance policy. My mother is the beneficiary. Will we have to surrender that money to Medicaid since they are the ones paying her nursing home bill along with her monthly social security check? Also one last question. She now will begin drawing half of his pension. Will this have to go towards paying her nursing home bill? They have a dependent child living at home who does not draw a check each month and money is needed for her continued care of household expenses.

Since she is beneficiary, she gets the full 5K and must spend it down within the same month or the Medicaid will stop due to assets over 2K. Her widow's pension must also go to paying for her care.
I am assuming the dependent child has a disability of some sort .
Please immediately see an attorney about Guardianship for the child, as well as SS benefits and Medicare or Medicaid for the child. Obviously the child cannot live there alone, so you also talk with the attorney about custodial care.

I'd get legal advice immediately from an Elder Law attorney in your jurisdiction who knows Medicaid rules. I would question whether mother has to accept the $5000. insurance payout, since it could disqualify her from receiving Medicaid. I'd ask about the procedure for renouncing it and how that works. Plus, there are questions about her increased income. HOW does your mother have a dependent child? Is this by age or due to some disability?

Thanks for the answers. I do plan to get an Elder Law Attorney in my area and will mention all of the things brought up in both of your posts. As for the child: she is their child yet an adult who is physically disabled from an injury in her adult years, but does not draw disability as she had not worked enough and earned enough credits- to have qualified, in the right time frame, for disability benefits.
