I have guardianship of my Mother who lives in Texas and I live in Oklahoma and I take care of everything her caregiver there pay, grocer, drs. Someone told me it wasn't legal because I lived IN Oklahoma?

If you have the paperwork done that states you are guardian, then you are her guardian as far as TX is concerned.

TX DAD's program has a really good brochure on guardianship. TX has like 4 types of guardianship level. It is DAD's publication # 395. DADS is Department of Aging and disability.

Now in TX to do probat, the executor named in the will HAS TO BE A RESIDENT of the state, if not, then they have to have a TX attorney of record. My mom is in TX and I'm in LA and am indicated as her executrix in her will. So in order to do this in TX, I will have to have a state of TX licensed attorney of record filed when I open probate for my mom. I can still be executrix but need a local attorney to be the pass through and the address for all documents to go to. Maybe your aunts attorney is thinking of this? Whole different issue.

I live in California and had guardianship & conservatorship for four of my family members with Alzheimers. However, none of these ladies had children or spouses and no one else in the family could or would step up. So, the court automatically appointed me when I petitioned for it.

My Aunts att. and no my grandmother is still in Tx & am in okla

If a court gave you legal guardianship, it's legal. Everybody's got an opinion. Who told you it isn't legal?

I'm not sure of all the laws, but did you move after you became her guardian? Do you mean guardian or do you mean Power Of Attorney? They aren't the same. Lots of people on this website are long distance caregivers. It's difficult, but they manage.
