I have many people who will testify on the duties performed by me for this elderly person and not paid. Her handyman is her POA. There is a great some of money involved. I believe that the CPA/executor and handyman POA are acting together. I have been by law, forbidden to help my friend. They wanted me out of the picture. They do not deserve any of this woman's hard earned money. I have seen the will leaving it to Animal Friends, however, I'm sure the will has been tampered with or lost. What can I do, and what type of lawyer should I see? I have found a 2 cousin who may have rights to this money in PA, but I'm not sure. They both had the same grandfather. No children involved. I just hope anybody but these thieves benefit from this estate. Please help???:?

Unless you had a written employment contract with the elderly person saying how many hours per day you were to work, what wages you would receive, how many hours off, what were your duties, etc. chances are almost zero that you can be paid by the estate after the fact. This elderly person must had been a really good friend for you to work all those years without pay.

If you saw the Will and it said that the estate goes to the Animal Friends, then that is where the money will go. It doesn't matter how many relatives you find. Curious, when you see this Will? And how do you know that the CPA/Executor and Handyman will be receiving money from the estate? Chances are the CPA will receive a fee for handling the estate, that is not uncommon.

If you still wish to pursue this, contact an Elder Law attorney in your area.

Why weren't you paid while the person was still alive?

" I have been by law, forbidden to help my friend. "

How were you forbidden BY LAW? Is there an injunction/restraining order against you? These aren't issued for spurious reasons. What was the basis for the legal action against you?

There's obviously more to this situation that has been written.

I suspect the POA suspects that you're after some of the estate assets and feels you should be kept away for the benefit of the person you cared for.

However, I would ask if you're that concerned about getting paid, why did you work for free for this person for 10 years?

massage, curious why you think the Will was tampered with? The writer of the Will choose to have a Certified Public Accountant to be the Executor of her estate. The CPA would lose his license if he had made changes to the Will, that is a high risk that no professional would want to take.

As for the handyman being Power of Attorney... that stopped once the person [the elderly person] had passed on. It is now up to the Executor of the Will to take the Will to probate. If there is a lot of money involved with the estate, chances are there was also a Revocable Trust.

Scam Artist is Handyman and P.O.A. and Executor of the Will leaving himself everything! I have been to the dept. where the will is - copyed it. CPA did not act in her best interest he is now 80 years old. She died this past summer. I have one year to prove this. I will prove this somehow. I'm not looking for "money" I'm looking for justice. I am a justice person. Yes, she was my Massage client. I was paid for my massage. Everything else I did for her, I did from my heart and her promises to me someday. Shame on me for helping a person who needed help???What kind of world do we live in. I helped her because she needed help, compensation or not -end of story.

Massage, could you explain what type of work you were doing for this older person. You mentioned you were being paid for massages. But for the other things you were doing, you were being paid in promises.... unfortunately, promises do not hold up in court.

So sorry your elderly friend had passed away this past summer. Once a person passes, then the Power of Attorney is no longer in force. What is now in force is the Executor of the Will. I thought it was the CPA who was the Executor of the Will. Is that correct?

Instead of focusing on what was lost from the promises, focus on the part that you were helping out a friend for many years. Hopefully someone like you will come along and help you the same way when you are much older. Chalk it up as being a really kind, unselfish human being, worthy of a lot of pats on your back :)
