I am a Malaysian and I have a 81 years old, US citizenship aunty staying alone in US and needs care from me. My aunty is staying at US. She does not have any child and her husband just passed away. There is no one who can take care of her. We have actually discussed on this and she would like me to move there and stay with her so that I can take care of her. However, I am a Malaysian and I do not have any green card/ visa to stay in US. Can I get guardianship for her? If yes, will I be able to stay in US with her?

This is an interesting question. I have no idea, but suspect you need the help of an immigration lawyer. Another thing to consider, to be named Guardian, a judge must decide that, and the judge might decide to choose a Guardian who is already in the US, such as an attorney or professional guardian through places like Lutheran Social Services. These are trustworthy, established guardians with proven track records. The judge may decide that it is more beneficial for your mom to have a Guardian like that, immediately, rather than wait for your immigration issues to be resolved. I hope I am wrong, but my instincts say otherwise. Another aspect--do you have financial resources to support yourself here in US? Does your aunt have resources to pay you a wage for caregiving? Do you have any reason a judge would not award guardianship to you (other than not a citizen) such as past legal troubles, health, or employment issues? I'm only trying to think of the questions that could arise in judges mind (lawyers & 2 judges in my family/ friends).

Hi all, thank you for the suggestions and guidelines. I do not have any financial support in US. My aunty would be able to support or pay me a wage but I do not want to depend her. I hope I could get a green card there. I do not have any past legal troubles, health or employment issues. I am current working as an IT engineer in Malaysia. My aunty mentioned that she would like to adopt me as her child but I think it is impossible as I am already 28 years old. This is really complicated.
