Have issues over my father's house. hey aren't making any effort to pay utilities the last I knew. I'm concerned about my father's mental state as well.

Your father's home and everything in it, including cars & boats, is your father's property. Did he give them an invitation to live there? Where does father live? Who is dad's DPOA? Need a little more info. But It sounds like bro & sil are not paying when you expected they would be....and if you are taking care of dad's affairs (hopefully you have DPOA) then you would be within your DPOA rights to have them pay up, or be evicted. If dad wants them to live there, and no formal rental contract was signed they are on a month-to-month lease, and can be required to leave with 30 days notice. Research the laws in your state and consider hiring an attorney to help you. If dad no longer lives in his home maybe it is time to sell it, but I don't know all your details. If dad is competent, it's all up to him to decide what they pay. If they are taking care of dad, he may be happy letting them stay there. Why are you involved in the decision making?
If dad is not competent, petition for Guardian status and if you win in court, you can ask the judge to set a compensation level for them.

right, not enough details - my dad had his grandson move in with him to take care of him with the idea it would also help him out in not having to pay any rent; of course there were no payments to be paid either; his house was paid for, though even if your dad's is not, like pam said, if they're taking care of him, he may be fine with going ahead and making the house payments and utilities. We even got grandson a check for taking care of dad on top of that to make up for his loss of income from not being able to work in order to be able to. Now as far as your concerns re your dad's mental state, several months after he got his grandson there dad wound up in the hospital and while there he gave me POA, while the hospital wanted me to petition for Guardianship of him but in order to place him in a nursing home, but we didn't feel we needed to do that then, so we got them to go ahead and let him go back home with grandson on a trial basis and see how he did and he got better when he was allowed to go back home but I realize your dad's still at home but if hasn't had any type of incident like that it can be really hard then to get Guardian Status; at least in dad's state it is. Now, I have the problem of dad no longer living in his house and they are refusing to do anything and threatening, so....you may need more than an attorney
