She's has demintia and accuses everybody is against her or stealing from her.what do I need legally to put in a nursing home.?

At this point you need to have two MD's declare her incompetent or you pursue a full Guardianship and get a court order with it.

Yep, guardianship is your only option at this point.

Guardianship is a huge step. I'd suggest that you see what can be done within your DPOA first.

Do you know where she stands financially? Like does she have 20-30K or more in the bank? Do you have signature on her accounts? And have access to her banking. If so, I'd visit several NH that are both private pay & medicaid, and pick 2 that have an available open beds & speak with admissions & social worker as to getting her admitted. Be very forthcoming that she is likely to be very unhappy with the move, etc but that she has funds to private pay (be accurate on the amount) but you have DPOA (take a copy). Then I'd suggest you set a tentative move in date, leave a smallish deposit (from her account), get the admissions contact & you go to see an elder law attorney before to the move in to go over her existing legal and the admissions contract. If you sign any paperwork, you need to sign all as "Jane smith jones in her limited authority as DPOA for Mary smith" or however it needs to read to be legal in your state. Then you get whatever new she may need for her room @ the nh all set up. Then take charge & move her in. yeah she's gonna be peeved but she's going to be that no matter what I'd bet.

If you don't have access & ability to her finances, then guardianship needs to be done. expect to have to front about 5K to get guardianship proceedings done. If there is any issues in your past or in your household,, or you have credit issues, no secure personal income, kid has juvee record,anything sticky, please speak with the attorney on this. The judge may award guardianship to the state instead of to you. Hopefully you can use your DPOA to get her moved. Good luck.
