I'd like to know, has anyone gone thru or taken there parent through a full diagnosis and legal appraisal of competency?

I find that the medical system and legal system seem to throw-the-ball back and forth in their evaluations. In other words, unless one gets a doctor, lawyer and judge to make the total competency evaluation together on the same day for the same exact issue, it's always in question.

Any opinion by the doctor -- can be challenged by a legal lawyer opinion. Any opinion by a lawyer -- can be challenged with a request for a medical opinion. And so the buck not only goes round and round, it costs the person a lot of cash!

My mom has a trust that she and my dad set up years ago. now has been dx with dementia (x 1 year). I can have general power of attourney (per her trust) she is not competent. She's had in home caregivers for 1 year, thinks her family is against her, and resists care. I want to protect her from spending thousands on her yard, and gambling-she likes to sit at the video poker machines. She has lost 50lbs this year, and often skips her meds. Any way to do this without a lot of costs? We have the trust, what next???? Patty

When I brought my father to live with me in 2005, I went to the courthouse and filled out papers to become his legal guardian due to his dementia / alzheimers. They appointed an attorney to rep him and I took the papers to his (new) doctor and after exam (simply) they filled out the forms and I submitted to the court and then it was a simple meeting with the judge, attorney and myself. No issues. It was not contested of course and very obvious to everyone that he could not handle anything himself. Brenda took about a month
