There was no long term planning done for my dad. I know dad will need to go into SNF soon. I am getting things in order. It will not be difficult to spend down his savings in a short period of time. I spoke to a number of lawyers and have been told that Medicaid will most likely assess a penalty. Have any of you had a loved one in a facility and had to deal with a penalty period? How did you handle that penalty period?

Why do they think there would be a penalty? Did ur Dad give money away during the last five years? Is savings all he has? Does he have enough to pay a SNF until Medicaid kicks in?

You make arrangements to privately pay the facility until the penalty period is passed or you take them home. You could try to get funds or property that were transferred back so that you can fund during penalty period, but options are limited. If you don't make arrangements to pay, facility has right to ask person to leave.

I would love to hear from someone who actually had to deal with the penalty period. What did you do?

Yes, money and a car were transferred years ago. There is no getting them back.

One has to spend down to qualify for Medicaid. You can only apply for LTC medicaid when the person is in the facility. There is a penalty period. You private pay or take the person home. What have you chosen to do at this point?
