I am applying for a waiver for my mother for home health care. She doesn't not own a house or any property and only has an insurance policy which I am not sure the amount yet but not anything extravagant. After she passes away do they come after the daughters or sons to pay?


Just curious as nothing has really started yet. We are in the beginnings of the process.

Clara190 First question is does your mom have a Durable POA for financial and medical purposes? A POA is used to act for the principal, in your case your mother. The POA has the fiduciary duty to protect and act for the principal. With that said, be careful of signing documents. Responsible Party is usually used to refer to someone applying for applications, admittance forms etc. THE POA should sign name then as POA.

My mistake, No in AZ as of today, , but they will require the insurance policy to be cashed in and used on spend down. As long as the money is spent on her and her needs you can do a number of things with it, get her hearing aids, dentures, glasses, new wardrobe, stock up on depends, pre pay funeral, etc.

Some states are starting to talk about filial responsibility laws to have children repay Medicaid monies. My home state, Pennsylvania is the only state enforcing the law to any degree. But this may change because, Medicaid funds for nursing homes are eating up large parts of state budgets and federal monies for long term Medicaid are underfunded. Qualifying for Medicaid may also become more difficult.

HI..
My Mother is in the philadelphia area. .We are in the beginning process of the waiver. Didnt get anything yet or even a visit for a evaluation yet. I was just wondering if the children would be responsible. I cant see that they would be because they are not the ones getting the waiver. But I wanted to ask just in case.. She has an insurance policy but I think its just enough for burial.. I dont care if they come after that. I just dont want them bothering me when something does happen because I am not her..

No. You r not responsible for Moms debts. If the policy has cash value you may be asked to cash it in. You can use it to prepay her funeral.
