My mom lives with me and I have recently started receiving 30 hours of respite a month @ $10 per hour to the caregiver..the agency Fivco) Pays 75% of the $300 cost and mom pays 25%...Fivco lady said that they don't send/file 1099's...am I or person caring for mom responsible for paying some kind of tax on this money that Fivco is paying or on the part that mom is paying...caregiver does not want to have to pay taxes and I can't afford to pay taxes on this...is this something I should b concerned about! The check Fivco pays comes in my name...we live in Ky..if I or the caregiver r going to have to pay taxes on this I'm going to have to stop having the 30 hours of monthly respite!

I am moms caregiver but do not get paid to take care of her..the check that Fivco sends to pay their part of moms care of respites in my name..I just pay the 25% of what Fivco doesn't cover I am a caregiver for my mom but I am not being paid to do it..five o lady was social worker evaluating for respite no there r no taxes taken out...I keep down hours turn them in monthly to Fivco all the respite care giver does is sign name date and # of hours worked..I'm going to call Fivco tomorrow and get some deffinate answers..

Fivco seems to be the quasi -governmental agency that serves as the local Area Agency on Aging and Ombudsman in the Five Counties area of Kentucky. They have several years of audited statements on their website.

When you say "the Fiveco lady" do you mean the caregiver or an administrative person in the office? I would think that Fivco is the employer and gives a W2, not a 1099.

Could you sit down with someone from Fivco and ask how employment taxes work in this situation? If this is a legitimate non-profit organization I hope there is no illegal activity going on here. Have them explain how this works.

Is the check that is sent to you for your own work? You said you get paid, too. Have they taken any taxes out of it? Does Fivco pay the respite worker directly?

Definitely talk to a Fivco person about this!

If this person becomes injured...they will file for workers comp. then you will be caught. The IRS defines everyone working in home care giving as EMPLOYEES. There is steep penalities...not on the employee...nope...on the employer. Employer ends up having to pay ALL the back taxes and withholding...even the part the employee would have had to pay. And...Fines on top of all that! The employees have no incentive to keep quiet about the illegal arraignment.

So..say this employee is no longer working for you...she goes and files for unemployment...she will get it...but...you are caught!

Sign up with a payroll service. You/Mom are the only ones with the huge liability...the caregiver cannot lose in the deal...file for workers comp if hurt...file for unemployment.....either way...you get caught and have to pay, and she gets payment..plus never had to pay the taxes either.

jeannegibs..I not getting paid for work..another person is giving me respite..coming to my home to shower my mother...Fivco is a program for in home help don't think it's anything to do with Medicaid as it's not based on her income...the check they send monthly for their part of my moms care is in my name and I add her part she has to pay

Are you being paid for your work, or is another person coming in to give you respite?

Is Fivco an agency for in-home help?

Is this a Medicaid program?

Help us understand this a little better so our answers aren't making wrong assumptions.
