If her husband is draining the bank account and continues to do so there will be no more left for her care in the future... what rights does she have at this point? What are the legal ramifications... if we can prove that he is withdrawing the money... what documentation do we need to support this? Can anyone offer advice on this subject? It is getting out of hand and I am afraid that the account will reflect a zero balance... I am not sure if he is giving away to family members? What if he has a safety deposit box... can he be forced to open it even if it is in his name only.. I do not know if there is one or if the wife is on the account? What if he is buying property with the money from the bank account? How do we prove that.. are there public records that would reflect the sale of the property or property taxes that will be due? Has anyone experience this issue? Any help and advice would be appreciated.

Who is her POA? Is the wife competent? The POA can take a copy of the POA document to her bank and find out what is going on with her account and if it is joint with her husband.

Since your post begins saying if he is draining the bank account, I wonder if you have reason for such suspicion? Later in your post, you state that it is getting out of hand. What's the it?

We really need more info to understand what is going on.

You posted this question twice. Are they married. Joint account? I think the best u can do is discuss this with a lawyer. The husband maybe hiding assets.
