You would need a formal Personal Services Agreement stating what you do for her and how much you're compensated.

Yes she would need to still have the appropriate expense to qualify. You could be a paid caregiver with the proper agreement.

If there is a POA already in place you can't file for Guardianship. You only do that if there isn't a current POA.

According to the law you do. That's up to you on how you treat it. It needs some specific language so that it is also acceptable if he ever needs nursing home care and applies for Medicaid.

Family caregivers (children not spouses) can also get paid to help their aging parents through the VA Aid and Attendance Improved Pension.
