My husband and I are both in poor health and unable to work. He is awaiting a disability appeal hearing. Right now we have no income at all and no health insurance. My father passed away in April leaving me some money which we have been living on. By law we now have to get health insurance.If we apply for medicaid will they take what is left of my inheritance?

Normally, when there are assets above a certain amount people don't qualify for Medicaid, but your circumstances are complicated.

States differ on what they allow and don't allow. Since your husband is awaiting a disability appeal hearing, you are likely dealing with an attorney for that. If this attorney can't advise you on what you can do as far as your assets and Medicaid, he or she should be able to suggest someone.

Yes they count an inheritance. So you have to spend that down in accordance with your state's Medicaid rules. Then you dig up five years of financial records for them to look at.

You can opt out of getting health insurance but the Federal government will fine you $95, but only if you are getting a IRS tax refund, to which they will take said amount from the refund if the refund if $95 or more. If no refund, then the $95 will carry over into the following year.

Hopefully your husband disability income will come in soon so that he can purchase health insurance.
