I gave up any rights I had when I divorced my ex husband. We settled up beforehand, financially, and went our separate ways. Isn't that the whole point of divorce???
Yes. And everything needs to be brought to the table. My GFs Ex sued her for an oil tank, after the divorce, that her Uncle had given her. And it had a hole in it.😁 You should not be able to go after an ex-spouse once the divorce is final unless it has to do with the children. Or, he/she did not carry out the provisions of the divorce papers.
W/o knowing more about your situation, and the "rights" to which you refer, I'm thinking that rights for parties in divorce are likely the result of state laws as well as court interpretations and holdings.
As already asked, what specific "rights" are in question?
If married for 10 years and have not remarried may claim SS based on ex-spouse. pension needs to be settled during divorce and remarriage may cancel those payments. VA pensions - spouse may be eligible if married while he was in service. Length of marriage determines rights to other VA benefits. Your being handicapped is not a factor in benefits. SS disability would be based on your earnings and ex spouses if married more than 10 years and not remarried.
If remarried and new spouse dies, you can collect against ex spouse. Stacy122 helped me with this and my mom now gets my dads benefits, even though they were divorced for 35 years and she was married to her 2nd husband longer. Once he died, she had choices.
However, you can only make a change once. Meaning that she wouldn't have qualified if she had changed from hers to her husband's while he was alive.
Need more info. What rights do u think you should have. Your age would be a great help in helping you.
Usually when divorced anything you want needs to be worked out before the final judgement. As Alva says, pensions can be worked out then. The longer you have have been married the more you may get.
Once you are divorced, ur ex is no longer responsible for you or you for them. Thats why the divorce.
Ex wives have very few "rights" concerning ex spouse, other than to some pension earnings that were earned during the life of the marriage. I am uncertain just what rights you are speaking of.

Just an FYI.
