My father was in a nursing home in New York State. He died in May. He was on medicare and medicade. He was allowed to keep $13800.00. Who is entitled to this money? It is in a joint account with myself(his daughter).He also had an account at the nursing home that daught had made a deposit to and the VA depoited into every month. Who gets that money?

I'm rather surprised he was allowed to keep that much money and still be on Medicaid. I believe the Medicaid people will have first say on this, but you can check with an estate attorney to see what your rights are. Also, are there other family members? Was there a will? These are all things to consider. Generally, Medicaid makes sure the tax payer's money is paid back first, if the person is on Medicaid, but every state is different. If you think the money should go to you and it doesn't, you'll need an attorney to help you. Good luck,
