Family member is trying to manipulate my mother to sign over guardianship even though it is not necessary. He is manipulating and eroding her confidence in an bid to control her finances.

This posting is extremely vague. How can anyone comment without any details? It’s your word against their word. Anyway, I believe the answer that you are looking for is Adult Protective Services. Please make sure that you have all the facts before making a report against someone. I sincerely hope that you haven’t misunderstood something and are jumping to the wrong conclusions.

If she is competent, he will not be able to get guardianship. Are you sure he isn't trying to get her to assign him POA.

With guardianship he will need to report to the state how he spends her money. I think he has to see her and make sure she is healthy and seeing her doctors. He will need to keep good records. As a POA there aren't the same restrictions and the possibility of frauding her.

Is there a POA assigned? If not, maybe you should have her assign you. To get guardianship it costs money. Mom has to be found incompetent to make informed decisions. The court then decides if he should be guardian. Mom will need to be present and you could be there to contest guardianship. See if there is a way that she can have it put in writing now that there is no way she wants this family member ever declared her guardian.
