My mother passed away. We need to get my forms to fill out on her estate. He was her care giver and still lives in the house.

Yes, I answered this question. If your Mom was on Medicaid she had a caseworker. That person should be able to help. Actually, anyone answering the phone should be able to give you the phone # of the person at the state level who can send you forms. In the meantime, brother can stay in the house.

Can you please clarify?

- Who is "we"?
- What forms on her estate are you referring to? Do you mean regarding Medicaid? Not sure there is such a thing. Do you mean in terms of your mom's remaining assets?
- Who is the executor of your mom's estate? That's the only person that has power to do anything. If there was no will, any assets she has left will go into probate and can be contested by anyone.
- Who is "he"? Did she have a caregiver that you suspect of financial abuse?
- If "he" is living in the house as his only permanent address you will need to file an eviction, but only if you are the homeowners.
