Bigragu, yes I believe that Medicare will pay for the hospital stay that was prior to requesting a patient to go to rehab or have rehab therapy at home. Call Medicare to double check.

You asked about elder rights? Are you in favor of the elder not having rehab? If so, that isn't in the best interest of the patient. Rehab can make a world of good depending on the patient's condition going in.

Now if the patient needs to go back to the hospital for the same condition, I don't know how Medicare would act, since the patient refused to follow doctor's orders the first time around.

No. Medicare makes the decision on how many days a person gets in the hospital. A person has to stay 3 days before they can get therapy in a rehab. Is it therapy is not being recommended or there is no room available.

Really need more info to help. What reasons are you getting for no rehab.
