My husband has dementia and I'm his caregiver. How can I make sure he's taken care of if I pass away? We have no family that can help.

Sue, you need to have POAs done that have a law firm as the 2nd for him and 1st for you. They will assign or hire a legal fiduciary and, we require oversight from our attorney, your wishes will be carried out.

You need to have a plan for what you want, ie he stays in the home with a live in caregiver and daily help from hired caregivers or housekeeper or personal chef and the live in mostly runs the show according to your choices with oversight from the attorney/fiduciary, or he goes into a facility with daily companions or whatever you want.

A good attorney can help you get this all set up and on record in the event something happens.

It's good you are thinking about this and preparing in the event life doesn't work out like you think.

You will perhaps want to set up a Trust now. But it is difficult to ascertain which partner will die first with aging concerns. I would see an Elder Law Attorney; he or she can recommend a Licensed Fiduciary such as those he works with in court when there is no family or family is removed as caregivers. Either this person, for a fee and under the court can take on care, or the state can assume care, and the Fiduciary will take over to manage the estate, as appointed by the courts.

I had a Special Needs Trust set up in case something happened to me. The Trust would provide for his care if I was unable to. This probably would have meant that he would have gone to Memory Care.

He needs a legal guardian and you need to consult with a financial planner to see how his care will be funded.
