Court declared that wards needed a guardian. The guardian is in a neighboring state and works 6-7 days a week so it makes it difficult to check on the wards as much as they need. They can't afford an assisted living, and don't qualify for convalescent care. Could they pay to rent a home that the guardian rents next door to his house? I know they can't enter in to a rental/lease agreement but guardian has agreed to sign the lease for them.

All financial decisions belong to the Guardian who must also get the approval of a Judge. The ward should qualify for a group home or apartment for the elderly/disabled with on site supervision. That's the safest option. BUT the Guardian can NOT use the ward's funds to pay himself, even for rent.

Thank you, actually in Georgia there is the Guardian position that takes care of health/facility decisions and the Conservator that takes care of the financial decisions. They would be paying the person who owns the house for the rent.....BUT the Guardian would be taking out the year lease because legally the wards can't do that. I don't think it's something that can be done....but wanted to get others input before speaking on the subject.

Oh and assisted living facilities in the area are $3500 and they do NOT have that much income. They are not at a point yet where they would qualify for a convalescence center. Not sure what you mean by apartment or group home. An apartment would also require a lease.
