Yes, he could have done that, if he was competent to understand what POA means. Does he have cognitive issues as well as physical impairments? Have you asked him about the POA?
Omarll, what is the issue that you are questioning? Was there a Power of Attorney prior with you being the assigned person? Or was there no Power of Attorney?
It is not unusual for a parent to assign a grown children to be their Power of Attorney, as they feel their spouse may not be able to make future decisions as they age. I know it isn't fair. Your hubby should have elected you to be his Power of Attorney with his daughter being secondary in case you were unable to perform as his representative. That is what my parents did.
