Im looking into putting my husband into a nursing home. What are my rights as his wife?

Will it take all his social security and disability? What will I have to live on? We dont own anything; renting apt & car. Only married 2 years.I don't know where to start. He is a dialysis patient who consistently refuses to follow doctor instruction. Has multiple complications because of it.

michele55, It is not Medicaid's intention to impoverish a spouse that lives in the community. (It would not make sense to take all of couple's income so that the at-home spouse has to go on welfare!) There are provisions for exempting some of the recipient's income for the spouse at home.

I suggest that you consult an attorney who specializes in Elder Law to learn how to apply so your interests are protected. Gather all of your documentation about income, assets, etc. to make the visit most effecient.

I am so sorry you are dealing with this so early in the marriage.

If he needs Medicaid to pay for nursing home care, Medicaid will take his Social Security and Disability pensions to help pay for his care. You will keep any SS or pensions of your own.

Here's some informative information about Medicaid: who's eligible, how it works, etc. If you don't own anything, there's probably no rush to consult an elder law attorney; yet my instincts tell me that, when you develop specific questions that can't be answered on line, you probably out to spend an hour with one.
