JessieBelle - again we are on the same page. I'm on my moms checking and savings - which has a decent chuck of change in it. I know I could just keep it upon moms passing since it doesn't have to go through probate - but since I'm the executor and a fair, honest good girl ( most of the time, the good girl part ) I will put it in the probate account and split three ways as my father wanted. Sometimes it sucks to be the good girl!

I should say that "she" can do that. I don't know if the she is you or not.

Yes, if you are joint on the accounts you can do that. Is it what your father would want you to do? It will avoid probate. Are there other people that he has in his will? I ask this because my name is on my mother's savings and checking accounts. Legally I could take the money as my own. But the will has that all money is to be divided 4 ways among the heirs. So I am bound by her will, even if my darker side might want to keep the money for myself (if any is left over).
