VA ER refused to remove a drill it lodge in my foot. The reason was it did not qualify as emergency. I was told to make an appointment. A few days later the infection was so bad I tried once again to go to the VA ER. I was told they were at compactly. I went to a private hospital and was given a private doctors number and told by the VA they would pay. His office refused because he didn't accept VA payment. Oh by the way the VA Doctor called me a week later to schedule an appointment for surgery. But by then I had the surgery. My wife beg the VA, by then I almost lost my leg and foot.

In answer to the question in the thread title, I say he can refuse 'til the cows come home. As to the VA Hospital refusing prompt treatment, I'm with Babalou.

In your position, I would contact my local congressman/woman and ask them to intercede.
