Who knew? I am selling my parents home, and just found out the POA is "old". Luckily the mortgage company sent me the updates I need to sell the house, and I can get it done tomorrow at the bank, settlement is thursday! The paperwork is from 1998, I never had a problem so far but it seems in Pa. they need to be "recorded". Just thought some others could use this information on their journey here. Guess the rules have changed..

POA's do not expire. Ask them where they want it recorded. You should have a lawyer at closing to avoid all this BS.

Actualy they have been great, they want this sale to go through as much as we do! Just needed some ammendments. Things seem to change over time, as I found out during the home inspection! I have had no problem with the POA for anything else, but apparently selling a home is different. I sort of expected it from things I have seen here. Can't wait until I try to transfer the car..LOL

All went well at the bank, all papers signed and notorized for free! I have found all the banks we deal with so this for free! Wish me luck tomorrow as this is the end of a 46 year part of my life. And no need to get another lawyer (and pay for one) . Sometimes things are easy if you look for the best in people and events!

When we had our attorney right up the DPOA, he had it filed with the county clerk.
We sold my mother's house back in June and didn't have an issue with it.

sounds like you are going to have no problems going through with the sale.

I had someone at the bank tell me I had to be my Mother's guardian before I could do anything with the money. I called our attorney and he said if I thought you needed to be guardian that is what we would have done. Have them call me. Needless to say I have NOT had a problem since.

Everything went great! Now to keep reminding Dad he agreed to this.. lol. I had no problems!
