What proof or documentation to you need to support your claim for contesting it? How does one proof certain POD's are getting more than their fare share?

I am not familiar with a POD. Do you mean Power of Attorney?

I was wondering if she's referring to "payable on death", as in joint tenants with rights of survivorship?

That is correct in Louisiana you can list multipe POD's on ac account (Payable on Death) on your bank accounts ...and  each individuals will get their portion of the proceeds, however, it is contestable.  If you set up a Life Insurance with a Beneficiary, Annunity with a Beneficiary or an IRA with beneficiary  these three categories are not contestable and supersede a will...my question is how do you establish if you want to challenge a POD that you feel you should get a larger portion of the proceeds over other individuals?

Cathy, what's the authority for contest? State statute?

If you feel you should get more than others, I think you really need to see an attorney versed in LA law, someone who knows LA statutes which probably most of us don't except Igloo, a knowledgeable poster here.

This is a highly specialized issue and really requires someone qualified to interpret LA statutory and case law.

Is it you who wants to challenge a bequest because you feel you should get more? What are the grounds to support this position?
