We both split the payment down the middle. He makes $1000 in SSI per month. Will I have to pay the car payment on my own?

If you’re not married, then all of his income will go to the nursing home. His debts will go unpaid. If your name is on the title to the car then you will have to pay the entire car payment. If your name isn’t on the title then you will still have to pay the entire payment if you want to keep the car, otherwise the car will be repossessed. If you can’t afford the payment, you might be able to lower it by refinancing it. But yeah if you aren’t married, all household expenses will fall on your shoulder if your partner goes in to long term care.

If you both will be on the title (which by the way is not a good thing to do), then he owns half. But Medicaid will allow him to keep a car. So I guess, you will be responsible for the car payment. Maybe when paid off, you can buy out his half and that money goes to his care.

If title will be in his name Medicaid will consider it his. In your name, no problem. But, you will not get anything from him unless you are married. A Community spouse is given enough to live on out of SS and assets.

Joanne, in Canada it is better from a financial planning point of view to have both names on the title of vehicles. I did not check where OP lives.

He will not be able to pay a portion of car payment for you if he is getting public assistance to pay for the nursing home. All of his money will go towards his care, less a small monthly needs allowance.

Unfortunately you are not married as that would give you some protection from losing all of his income.

I would try to refinance the vehicle for a monthly payment that you can cover yourself. Because they will repossess the car if payments are not made.

If your name's on the loan, then you have to make sure the payment is made if you don't want to trash your credit or risk repossession.

Finance companies don't care how you share the responsibility for the payment -- they only care about being paid.

Whose name is on the title? If you're on the title, you're responsible for the payment. If only his name is on the title you're not responsible. However, if you want to continue using the car, then you would need to make the full payment if he can't contribute.

Are you legally married to each other? If you are, you are a community spouse and that would mean a different situation on his share of cost for nursing home bill. But if you ar4e not, then I think it is all your payment now.
