in addition has sent them 3,000.00 of merchandise.  We have reported this to Detective Treat of the NY State Police. We have not received much direction or advice on how to protect my parents from continued Jamaican involvement and financial control.

Apply for emergency guardianship. If your parents have control of their finances and refuse to understand this is a scam, you have to take their ability to send money away.

If they are still competent, they can spend their money however they please. If that's the case, I'd remind them that when they need care and have no funds to pay for it, you will not be providing it.

Just out of curiosity- does anyone know if Medicaid is needed will they consider this a gift? Or, since a police report was filed will they understand this to be a scam and allow coverage?

There is a reason that the state police are ineffective...they have no jurisdiction of anything happening with funds going outside of the U.S. They really can't help you as their hands are tied. They can give you suggestions and try to convince your parents that this is a scam, but they can't do any type of prosecution or anything like that.

The FBI may be a good resource, but again, while they are able to prosecute outside of the U.S. using the extradition treaties we have with other countries, there are so many scams out there that this one case may not be a priority for them.

The best thing you can do as others have stated is to get guardianship over your parents....this is a long and expensive process and will involve a competency hearing for them. The bad news is that if they are both competent, you likely will lose the guardianship case (and still have to pay the legal fees). People who are competent are allowed to spend their money any way they want, even foolishly. But I totally agree with babalou...make sure that you make it clear that when they run out of money due to their bad decisions, that you won't be providing financial or medical help yourself.
