A family member spent 10 days in the CCU at the hospital, he was sent to a nursing home for rehab. He's been there for roughly 2 weeks. The nursing home told another family member that Medicaid screwed up and that until it is fixed and kicks in they do not have anyone to care for him during the day. He must be watched because he keeps getting up on his own and falling down, he fell 12 times in one day apparently. This means that my aunt, her husband is the patient, must be there all day every day to stop him from getting up. I am concerned about the liability she could be taking on. They are not young people, the patient is 77 years old and my aunt is 64. Is it legal for the nursing home to require unskilled family members to do this? In my opinion at the very least they should be paid for this.

Unfortunately there are some people who need a higher level of oversight than even the best facility can provide. They need to ask for a care plan meeting to discuss a strategy going forward and ask for the facility to do more - he may need to spend more time out of his room where there are eyes to see, they can also provide alarms to alert when he tries to get up, and of course somebody should be trying to assess and alleviate (if possible) the reasons why he wants to get up in the first place. Bottom line though is that is only a stop gap because it is almost impossible to keep people like you uncle from falling without having eyes on them constantly, the only foolproof way is to hire a caregiver to provide the extra care or to have family do it.

Oh that’s crazy! Your poor aunt and uncle. I know nursing homes can be short staffed but that is ridiculous. Speak to the social worker. If nothing is done make a complaint.

I've heard of facilities asking families to provide someone or hire someone to prevent falls.

The patient has Medicare correct? As such, he has 20 days 100 % paid for. After that up to 100 days Medicare pays 50%. Supplimental may pay for part of the 50% not paid. Your Aunt can private pay till Medicaid kicks in. I would want to know what error they made. And believe me, the home would not have someone sitting with Uncle all day even if Medicaid was paying. Aunt could call ur State Ombudsman and find out if this is normal.
