Yes, you can. Do you have a copy of the POA? They usually contain instructions along the lines that anyone should be paid for a service. That would include caregiving. Go to the website AVVO to pose the question to attorneys that specialize in elder law. You will receive responses,rules are different depending on what state you are in. AVVO also has peer and client ratings of the attorney. And make sure you retain an attorney with significant litigation experience or you would need to start over again if it ends up in court. Better to get this taken care of before mom passes!

You can sue anyone for any reason! People do it every day..Make an appt with an Attorney and see what he/she says.
