I'm trying to find feedback from those that have been able to access care under the Medicaid NHTD waiver program in NY State. What has been your or a family member's experience? Thank you! Our family member suffered a TBI and is nearing discharge from subacute in the coming months. We are currently applying for Nursing home medicaid seeing as we can't financially pay privately and wait most likely the 6 months it will take for such services to be made available. However we remain committed to bringing our loved one home so that she may continue to receive therapy *should* she continue to show marked improvement in the coming months.

Thanks @Geaton777. Yeah we're in NY State. NH hasn't been helpful in the least sadly. Ive done months of deep deep research. I've read of turn over in aides as well but agencies I speak to tell me places plan for this and one won't be left without care. Medicaid would pay for transport to and from appointments--that would still be the case if she were to go into LTC, as well. Im in a FB TBI group but no one seems to know this type of info. Thanks for suggestions.

My family is in NYC. Get an eldercare lawyer to do this, can't stress it enough. The spousal waiver worked great.

In our case, my mother did a spousal waiver for my father so that he could be placed in a LTC facility under Medicaid. He went into the rehab wing and Medicare covered the three weeks. After that he was moved to the NH wing and was "Medicaid Pending". We did not have to pay any money out at all. We filed his Medicaid application in April of 2023 and did not hear back until July that he was on Medicaid retroactively from March 1, 2023. The NH was paid everything and there was no private pay at all.

It required that all the assets that my parents owned together were moved into my mother's name only. We eventually had to file for my mother to be on Medicaid also, which e were able to successfully do, and she went into the same facility.

It is a lot of work. But I can say our lawyer did a good job. This is was not cheap but my parents paid the legal fees and the costs for their medicaid applications, not us daughters.

Thanks so much for the feedback @Hothouseflower. I hired an elder lawyer here in NYC but unfortunately I lost over a month with lawyers not showing up after paid consultations so that I could retain them. Others I reached out to didn't want to put the time in based on my mom's assets being not some immeasurable sum. We have had to spend down to get to being Medicaid eligible but will now have to private pay we are told at 22K a month for nursing home once the 100 days of Medicaid coverage in subacute end and won't have Medicaid in time. My mom is divorced so no spouse to shield assets. My mom will be broke in order to get Medicaid.

Since Medicaid programs are state specific, it might be better to join Nextdoor.com and ask people in your actual community what their experiences have been. This is a global forum and probably not the best place to find the info you need. FYI once a Medicaid application is fully submitted it usually takes 3 months to know if your LO qualifies or not. If you get mail from them open it immediately as much of it is time sensitive. In-home Medicaid is does not provide as much help as in-facility LTC. From everything I read on this forum, there is a lot of turnover in the aids, and the recipient (your LO) has limited medical options since they can only go to providers who accept Medicaid -- at least that's how it is in my home state of MN. If your LO is not mobile you will have to work out how you would even get her to appointments. There are a lot of details to think about. Maybe the rehab facility can recommend local support groups for families of TBI patients? Or FB group? They would be a wealth of knowledge and wisdom.
