I have children who want their inheritance now and a spouse who is gambler....I fear that the assets that need to last a lifetime could be gone in very little time.

is there such a thing as entering into a voluntary conservatorship? I am under 65, would a self funded special needs trust be more appropriate?

I agree with other posters that an elder law attorney is needed. He/she can set up a trust for you. Maybe a trusted CPA can manage the money but I would see what an attorney has to advise first. Good luck and Take care of yourself.

I too would say to seek the advice of an Elder Law Attorney. You sound very intelligent and I have to commend you for seeking help yourself to make sure this is taken care of. I have never heard of Ayudando Guardians so I personally could not comment on them. If you have a highly trusted friend who could go with you to hear what is said, perhaps they could help you make the decisions you need to make. You may want to see more than one attorney as well if you are not sure that their plan is what you want.

Your situation with children wanting their inheritance NOW seems to be more prevalent these days and it is heartbreaking as what you have earned does not even belong to them until you are gone and normally until your wife is gone. If your wife does have a gambling problem then setting up your estate to where she only has money to live off of may be the best bet, to save her from herself.

God Bless you BabaYaga!

I'm so sorry to hear about your situation. Someone will know more about this than I do, but first you will need an Elder Law lawyer. They could advise you on how to protect your assets and how to ensure that your money will last as long as possible. Do you have someone in mind to become a conservator for you?
