My mother's care was paid with her social security income and medicaid. Mother stopped eating 2 weeks before she died. She had been wheelchair bound and she was blind in one eye. The nursing home sent a bill for $1208 for the last 4 days of her life. When I contacted them they advised me that medicaid will not pay until patient responsibility is paid.
I had an attorney send a letter indicating they should cease billing and to contact their office with any questions as I had not signed anything indicating that I would be responsible. Nursing home continues to bill every month for the same amount.

That bill sounds like the room and board charge, not the Hospice charge. Can the lawyer follow up and see if they received her SS for March?

Yes I received a claim showing medicare paid $976 for Hospice
March 02-March 05.

Cover, SS payments are not sent on the first of the month. They are sent on the 2nd, 3rd or 4th Wednesday of the month, dependent upon the date of the recipient's birthday. My DH's birthday is on the 4th; he receives payment on the second Wednesday of each month.

Thats why I think is going on is that she died the beginning of the month and her March check was due like the end of the month and her acct was shut down before the payment was made. SS may need to be given a call.

I assume the nursing home is billing your mother. Ask for an itemized billing. If your mother has an estate left (I assume she doesn't if on medicaid) then pass the bill to the executor of her will. The bill is hers and she is gone. They cannot do anything whatsoever to you. If you are her executor as well as having been POA (which ended the second she died), and if your Mom has a home, you will be dealing with clawback. You can then pay any outstanding bills as the executor, and settle the rest on her heirs if any. I am sorry for your loss.

Not sure what is meant by a contract. Perhaps you are thinking about the POA that expires once the loved one passes away. After her mother's death, the bills get paid by the deceased's estate. It is not the survivors debt, so her mother's surviving family owes nothing and should not send payments. Goes to Medicaid in the state where the deceased had lived, instead.

How did the NH receive her SS payment, by you or were they payee?

The SS payment received each month is for the following month. Mom died in March, she is still entitled to March payment because it was for February. April she would not receive anything because she died in March. If no March payment was made, someone needs to call SS and find out why. I have a feeling because Mom died so early in the month, that when SS was notified by the Funeral Home of her death, her acct was shut down before her last payment was processed. If I am correct, someone needs to call SS to request her last check. If you sent a check to her NH monthly then you make the call to SS. If the NH was payee and did not receive the March payment, they need to call SS. That's why I made Moms NH payee, so I would not have this problem.

If I am correct, that March check should go to the NH. Even if less than the $1208, IMO thats all they get. Thats what they got monthly for Mom and Medicaid paid their share. They deserve no more than that.

Was she on hospice prior to her passing? Does Medicaid in her state not cover hospice? I'm so sorry for this aggravation, and for your loss.
