The new attorney will NOT give or delvulge the name or copy of that portion of the trust! I have brought my mother to office, and has been VERY EVASIVE and rude on trips to his office or on phone, about copying this position, for myself, mother and older brother. I fortunately had seen this "position" in the revised trust when it was delivered! It was removed from the trust book, and younger brother will NOT be forthright about it!! He is covert control narcissist to max! I just remember reading he can move and research, past records, electronically, etc. I'm sorry I cannot recall exactly what this position was, never heard of it before! We paid $50 for another copy and secretary said she cannot give us that portion!! My mother has called and been with me to the office! SHE IS 98 yr old, hard of hearing, and this is causing great strife for all but spoiled YB. Does anyone know what this financial control position be? How can they keep this from copy of the trust? My OB, me and mother have since gone back to the 2nd wonderful attorney, and also does not know what this "power move position" can be? It is not DPOA, as I am, and OB is first trustee after mom. I am 70 and OB is 73. YB, 64, and am sure waiting for ALL of us to die first. It is nothing but control and greed on his part for HIS family, who are WELL off, 2 sons are Dr's. He has lived with my mother over 15 yrs, end of divorce, and and has done little in the care of my mother, nor paid one bill in his name. He literally says "Dad is gone, and now I AM John". He has saved close to a million dollars, and still not enough! Sorry, need to vent this anger. YB was my mother's 'golden child', and caused a big part of this mess. Now that my OB has been involved, lives 1800 miles away, she's realizing what a mess she's caused. UGH!

If I was in your situation and my mom didn't know what was in her Trust, I would have the Trust restated and specifically remove any changes that were made on that date and remove all addendas, even if you don't know what they are.

A good attorney can do this to protect your mom. It is the cheapest way to go if all of the assets are already titled to this trust.

Your attorney is the only one who can likely tell you what YB has done. He can't do anything specifically with Mom's trust as it isn't his, right?

Whatever he had done was likely done for him, and is therefore his business. The attorney can't change Mom's trust without her participation, and if she did participate, then she's entitled to a copy.

Exactly, I would file a complaint with the BAR association.
