Can one remove themselves? Can the one that does nothing (paying bills and contact at home and hosp) get guardianship?

Dear talbcl,

This is a tough situation. I think it really all just depends on what each person wants and is capable of handling. I would suggest a meeting with an elder law attorney to get this straightened out. If people no longer want to be a POA, they should have the right to remove themselves.

The POA should state how a person can decline the authority given in the POA. It's not hard to do, but I do recommend seeing your grantor's attorney.
