(Yes I will be calling on break to verify everything) My mother in law passed away August 15th she was on Disability. Her disability check hit her account August 20th and her partner took the money out. Disability came and took the money back out of the account (I'm assuming over drawing the account) Her partner is now saying that we need to send paperwork back to them because that check was realistically for the month prior and she is entitled to it. Is this true? If she was alive for half of August does that mean she is also entitled to half of august Payment as well? Has anyone ever dealt with this? If so how long did it take to get the check back?

I would call social security, because SSDI is different than SS benefits received at retirement.

Maybe go online to SSA.gov and research it. I would not depend on forum information because you are talking about a disability insurance.

Not August, but yes July. Time frame, I do not know, the wheels do move slowly in these government operations, especially, if it is in your favor.

She’s not entitled to half of August’s payment. She had to have lived the entire money in order to be eligible for August’s payment. Social security pays one month behind so the partner is correct, the payment received on 8/20 was for the month of July and she/her estate is entitled to keep it.

Thank you!, I have never dealt with any of this before so I was unsure. How long does it take to typically have it returned to the estate since they already took it back out?
