The court assigned a guardian and conservator for me mom!!!!! How can I get guardianship from the court in the state of Alabama??? I am her daughter and need help!!! I don't have the finances to hire an attorney! Thanks

The court considers all possible family members before appointing an independent guardian. If one sibling objects to the other, the Judge will not appoint either one. If the prospective guardian cannot pass a background check, including credit and criminal records, the Judge will not appoint. If you signed off and said you didn't want the job or you failed to show up in court, the Judge will not appoint you. The courts will avoid a prospective Guardian who doesn't have any money, to protect and preserve the assets of the parent. Sorry to have to say all that, but I have been through the process, and that's the way they called it.

Did you have guardianship and lose it? Or when this guardianship was set up, why didn't you get it then? Is there any reason to think that the guardian won't do a fine job?

A person does not need a lawyer to petition a court for a legal situation. You can on your own petition for guardianship. Your success without a lawyer is slim to none. Why is it that the courts found the need for an independent guardian? Most courts would prefer a family member to have guardianship over an elderly person unless the person has a criminal record or has shown irresponsibility on handling financial affairs.
