My mom is 72 and 25 year survivor of lung and brain cancer. cognitive skills have been declining. she exhibitors symptoms of parkinsons but not diagnosed with it. she fell and broke her hip end of august. went to a rehab and was making progress. She contracted Covid in rehab and this knocked her back to square 1. It is only my father who has limited mobility and myself who now resides in florida. I flew in and noticed my mom steady decline. well the rehab failed to diagnose a UTI and severe dehydration which let her to a hospital visit. the hospital pushed her in to another facility which is telling us she has to leave on christmas eve. we applied for Medicaid but do not have an ID number yet. We would like to rehab her and bring her home but my father cannot solely take care of her. Everyone seems to be providing incorrect advice...from the hospital to the nursing home/rehabs. what options are there...how can they release her to a home without proper care? Im saddened at this situation, as there is only so much i can do

Find Care & Housing
You have to tell them there is no one who can take care of her at the house and it will be an unsafe discharge. The place she is in is under pressure to get her out of there and get someone else in that bed, and they will sometimes make all sorts of promises about what is available for homecare. Be wary, they are often not aware of how things really are out there, or are being dishonest.

What precisely is the current facility your mom is in? Is it a LTACH aka Long Term Acute Care Hospital?? Or is mom in a specialty rehabilitation facility so she is a rehab patient? Or is she in a skilled nursing facility aka a SNF and precisely what type of bed is she in? fwiw almost always a SNF will have beds that are for rehabilitation patients in addition to the beds for custodial care residents. How a bed is billing makes huge difference as to what her / your options are.

what she is in???….the type of bed she is occupying, is super important as to what can happen.

also what does she have for her health insurance? She has Medicare but does she have:
1. Original Medicare and a supplemental plan, like she has BCBS and it is her supplemental or “gap” health insurance to go with Original. & if so, it will be a category. Like could be a Plan F if she has had it a long time. Or maybe a Plan G.
or
2. did she switch to a Medicare Advantage Plan?

You posted doing paperwork to file for Medicaid. So was this actually filing for Medicaid as HEALTH INSURANCE? Not Medicaids Long Term Care program? Medicaid LTC is a different program and has all sorts of documentation required to be submitted and has narrow eligibility BUT Medicaid as health insurance has way way more latitude as it’s kinda easily eligible if they are only modest or lower income…. Like their only source of income is their SSA $.

if they are in a facilty as a custodial care resident the LTC Medicaid program can pay for their room&board if they are eligible. PLUS also will go onto Medicaid as health insurance. They become a “dual” as in on both Medicare and Medicaid as health insurance and then have LTC Medicaid paying room&board. So btw the 3 all costs covered.

So what is she in? and how is the facility billing her stay?

I'm trying to follow as best I can and it appears that your mom was in rehab, the hospital, then perhaps in a rehab facility which is releasing her. Medicaid has not kicked in yet. She has to come home but there's no one there to take proper care of her. Other people I'm sure will offer more detailed advice regarding the law but my advice for you would be to hire her temporary CNA/ caregivers until this matter gets straightened out. This way the burden will not fall on your father who cannot do this.
Also very important too is for everyone to stay on this UTI situation with her home health aides and her doctor. Make sure that her private parts are cleaned only with baby bath materials.
The lack of health Care for seniors and their well-being is appalling to me. I'm so sorry. It appears that no facility wants to take responsibility.
