I am legal guardian over my mother. My sister has a medical POA. mom lives with my sister. Sister is not making safe choices for mom by having our dad watch mom while she works. At first we had co-guardianship then she wanted to come off so that she could get paid to take care of mom. So now she doesn't even want me in her house so I can visit mom and check to see how she is doing. Can I legally take my mom out of her house and put mom in a facility so she will be safe?

Read your Guardianship papers thoroughly. It is a court order, which trumps all other documents.

Iinanwal, curious what does your Dad think in regard to him having to watch and care for your Mom while your sister is at work?

I have unfortunately learned that my sister is named on moms Maine health care advance directive. So there is nothing I can do now.

As a legal guardian, yes, you can remove your mom from her house. As a legal guardian you can legally make decisions on behalf of your mom that she may not like such as removing her from her home.

Make sure that you always carry your guardianship papers with you.
