My dad wants to pass away at home not in the hospital is it legal for me to keep him home and to let him pass away in his home

Yes, it is legal. What you will probably want to do is contact hospice. Perhaps you can have your father's doctor prescribe hospice for him. They will provide healthcare services for him at home. They will also handle the technicalities at the end of life, such as signing the death certificate. This sounds small, but it is very important.

Are you his POA? Has he completed DNR, final wishes, etc?

Reneesizemore, if Dad is at his own home, make sure you have plenty of people around you to help with Dad's care.

Otherwise, if it is only you as his caregiver going over to help him or staying with him full-time, at night you might find yourself at night getting up every hour or every half hour to check on him [I know I would be doing that]... without enough sleep you will burn yourself out.

It might be legal, but only if he has no cognitive deficits. You ask Hospice to evaluate him. Bear in mind that if he dies at home without hospice, you have to call 911 and that gets messy.
