I'm working under an agency and the client that i'm taking care wants to find a different agency. She said she needs someone who can drive. Did they sign any contract from us? She's rude and i don't really care loosing her. My concern is, will the fine if they do that? Do they have a contract?

Why do you care if the client has a contract or will pay a fine? That is the business of the agency owner and the client. I would never discuss such things with my mom's aides. I can assure you that any legitimate agency has a contract with the client. Contracts may differ from region to region and state to state, just as costs/hour do. If you, as a caregiver/aide, are not meeting the needs of the client, then she has every right to either request a change of caregiver, or a change of agency. She will need to follow the guidelines as written in the contract that she has.

When I hired a professional caregiver Agency, they interviewed me as to what were the needs of my Dad, and I interviewed them. Driving was on the list, and the Agency would allow the caregiver to use either my Dad's car or use their own car but the client would be billed for mileage if the caregiver used their own vehicle.

The Agency I used, I could cancel the contract with one week's notice. For my Dad the Agency sent many different caregivers as matching personalities was very important. Like Dad wanted someone with a good sense of humor, and someone who really took an interest in his many stories :)

I'm coming at this from the other point of view. When we had our very first meeting with the person sent from the agency to do an accessment and care plan we stressed from the very first that a caregiver willing to drive my mom was critical - in fact that it was a deal breaker. At first they kept sending people who couldn't or wouldn't drive. It wasn't until we told them we were going to try a different agency that they finally sent someone who could drive.

I am sure she has a contract and I'm sure it did not include a chauffeur.
