Fergie, if you are on Medicaid you can have a lawyer set up a Special needs trust for the money to be placed. Medicaid will be the beneficiary. The problem is, you must abide by certain criteria. You can pay for your cell phone bill but not the phone. (My interpretation reading my nephews) You can pay for a cable bill. Stamps.

Its not the Nursing Home or SSA that has anything to do with this money, its Medicaid. You need to contact your caseworker. You will be allowed up to the asset cap. The balance I have no idea how that will be handled. Can u prepay for a funeral?

Have you asked your social worker? Otherwise I'd contact the SSA and ask them.

I applied for SSDi before I had to come to the Nursing Home, I have done this all myself without no help from an attorney or Social Worker, didn't feel I needed it, got approved on the first attempt ,only 22 percent of the people get approved on First Attempt ,..........................Social Security sd there is nobody on my account as far as payee, I am the Beneficiary, Hospital hasn't sent any Bills or advise me in this matter, they did mention that they could possibly take all of it ( Back Pay ) I know they can take all but $130 of my monthly benefits, I have talk to a bunch of Attorneys, It 50 - 50 yes or No, they advise to put in a Trust Fund where nobody could touch it
