Husband does not have POA but the wife does. Is it legal for the husband to gain access to the Family Trust Bank Accounts even though he is not a member of the family/family trust? The wife allows him to act on her behalf but he only wants access to take monies. The wife's mother who has given her POA will never know if someone (him) is taking her monies. The wife's mother is still alive (84) but the father is deceased.

You haven't really been clear about who set up the trust and why. Unfortunately in this digital age anyone can access accounts so long as they know account and PIN numbers so they can easily get around the requirement for POA. Bottom line though, Is the money being used for the proper reasons, i.e. is it being spent on his MIL and used to pay her expenses?
