what kind of lawyer or representative is needed to handle the following situation? (elder law attorney/mediator?).....both parents are incapacitated, their property out of the country may be sold soon and that money must be used for their healthcare, siblings are not getting along at this point (unfortunately, a quite disturbing situation), i have DPOA (have not used it) but some siblings don't agree to it and have threatened to oppose it in court (has not happened yet), one sibling who is being manipulated by another sibling will most likely try to have the $ wired into their account and let's just say, they've demonstrated enough evil ways that they cannot be trusted since to them it's all about control & ego....of course, if you ask them, they would say that i can't be trusted (although they would not have an example to provide) so the bottom line is that no one trusts each other at this point & aside from ending up in a court battle, what independent person can resolve this & from my perspective ensure that the $ is being used for my parents well-being only, does having an independent person mean that we (as their children) no longer have a say in the matter??

Your siblings don't have to agree to the fact that you are the DPOA. Why have you not used it yet? This is the time to use it. As the DPOA, you are the only one authorized to sell the property in your parent's behalf. To appose your being DPOA is stupid and probably will be thrown out of court because you are the DPOA. I'd call their bluff and tell them that you are the person authorized to do your parent's business and not them and if they attempt anything criminal, you have the authority to take them to court. I'm not sure going for guardianship will provide much more than what you already have. I've read several people say that it costs about $5,000 to get guardianship which requires a trail to prove your parents are incompetent. I think that I would get an attorney's advice about weather or not you really need to go for guardianship. If you file for guardianship, the court can rule to either place you, one of your siblings or a third party as guardian. I wish you well in dealing with this mess.

You should seek a court-appointed guardian as soon as possible to protect your parents.

I am so sorry for your unhappy situation. It sounds complicated enough that you should consult an Elder Law attorney.

One possible outcome is to get your parents declared incompetent, and ask the court to appoint a guardian. As I understand it, that is complicated and expensive, as the guardian must be paid for his/her services.

Maybe the attorney can give you an idea of how much that would cost. If the siblings realize that their arguing is costing the estate $10,000 to $20,000 a year, reason might prevail. I just made up those numbers, but don't lawyers get paid $100 to $500 an hour?
