They do have call alert buttons, but the nearest manager is 35 miles away. Also, her across the hall neighbor is on oxygen and smokes. This is a very nice, high-end facility, but I am becoming more and more concerned for her welfare. Is this legal?

Independent facilities are exactly what the name implies, places where people who are able to manage INDEPENDENTLY can live together for companionship and to more easily access extra outside care.

Well, it's not illegal......My parents lived in an independent living facility - but half of the building was assisted living and there were round the clock nurses & staff to handle any emergency. PLUS, the maintenance man lived on site. So...first check with the management to see if there are ANY staff members on site 24/7 and if not.....look into moving mom to a better staffed facility.

Oxygen and smoking- good grief

At 92, it sounds like mom could benefit from assisted living - is this a continuing care facility or is a move to a new one needed?

What do you mean by locked in? They have to have fire doors for exit in case of emergency.

How far away is the nearest fire/rescue service? If it is just a few miles away, a resident could dial 911 if they need help, or the alert pendent goes to the central dispatch. If the building is locked, chances are the fire/rescue service has a key to the front door.

I assume "locked in" means a secure entrance just like any other apartment complex. As for fire and medical emergencies, even at AL one or two night staff would never be able to evacuate a building and no one but an RN will touch anything medical, they call for help and let the pros take over.
