I've called 20+ elder law lawyers and none of them accually represent the elder law as I understand it. We really need help on this one. She has been sexually assaulted to phycologiclly abused. Can some one help me, we need a lawyer.

This is a police situation. Call 911, report the abuse and have her transported to the hospital, then you can get her moved to a different facility from the hospital.

I live in AZ and we had a severely disabled young woman that had a baby out of the blue. Found out the scumbag aid had been raping her for years. She couldn't resist, report or anything, what kind of sick, sexual pervert could do such a horrendous thing?

Yes, it absolutely is a police matter on day one. A felony rape and assault would have the perp in jail. I do not understand why the OP has taken no actions (that we are told) and this is why I have asked for a few days for some answers. The OP has not returned to the site.
This always makes me question what we are not being told in these circumstances.
Our OP tells us that more than 20 elder attorneys were consulted.
To be honest, out of that 20 at least one would have been smart enough to tell our OP to take this immediately to the Police and that it is a CRIMINAL LAW ATTORNEY that is needed now. That this wasn't done again makes me question this story.
I hope the OP will return to fill in the gaps for us.

You need to call Adult protection services to investigate. They can help u move her to another facility.

Just curious, why is a 39 yr old in a NH?

GMann hasn't returned to answer any of the questions nor to comment. Likely we cannot help/him or her. There would be many reasons for someone this young to be in care. There are many accidents that paralyze and debilitate and many illnesses as well. I have a young person in extended family with Central Pontine Mylinolysis, where the myelin sheath is lost in much the way MS can do it, but instantly, causing very poor gait, balance, fine motor control of hands, speech difficulties and etc.

I don't expect that this OP will return to us to answer or participate as so very many do not, but I am hoping I am wrong. I am kind of trying to keep this one bumped up a few days by responding so it rises, like cream, to the top. I hope thereby to keep it active just in case our OP decides to return to the Forum on which he/she asked a question. Sometimes I suspect they return after days, when their thread is on page three, and they can't figure out where their question went. So hard when you first join and can't figure out what a DD or an OP is!

Gmann51, Elder Law Attorneys works in the field of estate planning, financial planning, Wills, Trusts, Medicaid planning, etc. I am sure the first few Elder Law Attorneys gave you same answer, so I am surprised you kept calling others.


As mentioned earlier, you need to call Nursing Home Abuse Attorneys. Also try Personal Injury Attorneys.

Firstly, have you reported to:
1-800-392-0210 or online at Health.Mo.Gov/abuse.
These are the reporting agencies for your State.

You don't want an Elder law on this.
This is CRIMINAL law.
Was the abuse and sexual assault reported to the police, and when did this abuse occur, when reported?

First of all your daughter is not an elder at age 39.
She is however, surely disabled if she is in are at this age. Can you tell us, please, what her disabilities are?
Is she a competent reporter? That is to say has she a PHYSICAL debility, and NOT a mental one?

How did the abuse come to your attention?
Is there proof of the abuse?

I am truly sorry to ask all these questions, but here on the Forum we often get allegations of horrific abuse in a question, and then the OP (original poster; that's you) doesn't return ever again.
It is crucial to any advice we could provide for you that we know something of what happened, and when it happened, and whether the assaults were reported to authorities.

Did none of these "20+ elder lawyers" not refer you to the police? To criminal attorneys? If they DID NOT, what was their explanation for not doing so.

What did the administration of the facility say to your allegations?
Is your daughter still in this facility?

Look up nursing home attorneys in your area a ton of them will pop up in your Google search.

You would think one of these eldercare lawyers would have pointed OP in the right direction to the lawyers who do handle these cases . Sheez .
