The man in charge of conducting the care conference had promised to include me with a phone call. The time came and the Medical POA convinced him that I did not need to be there because care was medical, not financial and I was not included or even told that I would not be called. The individual in charge promised that I would receive details on the conference from the Medical POA and from him. The information I received was incomplete and what was written was in conflict - the reports varied. The man from the facility promised to answer my questions but to date has not done that. Additionally, many of the subjects touched on finance issues.

I absolutely agree with JoAnn. This is why it is exceptionally UNWISE ever to make one person the financial POA while another is the medical POA.
It is a MESS, and will almost certainly remain a MESS and the only answer to this sort of mess is an attorney.

I would work this out. It has NOT become a financial issue until you are asked to pay for something. Step back, calm down, and work this out with the Medical POA or pay the consequences of not being able to get along. Said consequence is-- MESS.

Agreed!! The problem is that I am in CA and could not respond quickly to a health situation in PA.

This is why one person should be both financial and Medical POA. As the Financial POA you do not need to give financial info to the Medical POA and the Medical POA does not have to give you medical info.

The car, only you have a right to sell that. And now someones in care, it can't be given to anyone. You may want to remind the director/administrator that you pay the bills, not the Medical POA. And because of that, you need to be made aware of certain things.

You are so correct about the POA's - just finding that out!
As for the car, my POA states that I have the right to gift anyone including me as her agent up to the IRS allowed limits of gifting. So wondering about your comment about the car. It may make sense to put it in my name or someone else's.

Hi, Thank you for your thoughtful and helpful answer. As Financial POA I am responsible for the assets of my sister. In the conference her car was discussed and since she does not drive they may want her to move the car. I am unable to get any information on this from the Medical POA or from the facility. Hopefully they will get back to me soon. Also there were issues regarding supplements which are expenses that I would pay from her accounts and also an increase in the care cost due to an increased level of care. I wanted to determine what they were doing because I speak with my sister at least once a day and see her on an Alexa show 8 and she is often not dressed in the afternoon.
The organizer promised that both the medical POA and he would give me notes on the meeting. Both were brief and were not the same! While many topics could have been discussed I would have thought that all topics would have been covered by both or at least most. So I really have no idea of what was discussed. Also, as Financial POA I am in a position to evaluate the level of care that my sister is receiving and if this is not sufficient to move her from that facility.

Just another point - when I asked Attorney google he said that under HIPAA regulations long term care facilities have obligations to disclose patient information to designated individuals including family members and financial poa.

I would escalate this to the Executive Director of the facility, for starters.

Thank you for that. I copied the director of Personal Care Services in a letter to the coordinator but I will determine who she reports to ... Great idea. Thank you.

Maybe you have recourse. I would take the information received and pass it by a certified elder law attorney to see if the conference leader and the MPoA need a letter from him/her to "clarify" roles. The man who conducted the care conference had no buiness promising you the information, this is a breach of sorts. Very unprofessional, a rookie move. The MPoA will hopefully not block you in the future as you both need to work together to manage appropriate care for your sister. "Many of the subjects touched on financial issues." Like what, exactly? I've been to several care conferences for my MIL and never was anything financial ever discussed. It's about *care* not *costs*. It's possible the facility is poorly run... I've had experience with such a place. I wish you success in sorting it out for your sister's sake.
