I am 50 year old female. I took care of my mom "Parkinson's disease" for 2 years. In that time she sold me her SUV. Ok she signed title but I never went to DMV. Forgot honestly. My poor mom was very hard to take care of. She went in nursing home and just recently passed away. What can I do about SUV?

Was your Mom on Medicaid? Was the car listed as an asset? If not listed as an asset, then I would think all you need to do is put it in your name. If she had sold it to you before Medicaid kicked in, the money would have gone into her acct and paid for what she needed. I have a feeling you were using it primarily so she gave it to you. No fraud or hiding of assets were intentional.

In my state of NJ, all u do is write GIFT where the sale price should be. No sales tax needs to be paid. I know my brothers state charges a tax when registrating that is calculated on the worth of the car every year. But, u won't know how it works until u go to the DMV.

Take the title to the DMV and get it in your name.

You shouldn't have any issues because she signed it.

You may have to sign an affidavit that you are her next of kin but, honestly I wouldn't even say anything about her death unless they bring it up. Then they will tell you what you need to do.

I was told that a signed title is a signed title and easy to transfer. I, unfortunately, did not have a signed title.

Medicaid is a different story and they may or may not see it as an asset that was gifted. Deal with that bridge when you come to it.

Look up your states BMV website and see how they handle this. There should be a section on transferring a title from someone who is deceased,

If mom had signed it Transfer on Death (TOD) to you, you would have had no problem getting it titled in your name.

Did you keep the record of payment for the SUV? Did you pay fair market value for it? Because if not it could be considered "gifting" by your Mom if she every required medicaid. I would start with just going to the DMV with all the records you have of the sale to you, and find out if title can be put in your name. If you are her only heir take the will, the death certificate, etc. with you, but only present your proof of sale and death certificate unless more is asked for. Start there. Either the State will come at you with accusations of gifting or not, but I doubt they would catch up on this one. Just try to get the title put in your name and tell them as you just told us that you were too busy caring for your Mom to even remember to transfer title. Good luck, and worth a try. Hope others may be more in the know on this than I am.
