Normally, if someone has medicaid, there isnt any $$$$. They are only allowed to keep $2,000 under medicaid guidelines.....She had to spend down the $$$ before she would be accepted for medicaid.
Is there a statute of limitations as to how long Medicaid can wait to claim? It appears to me that Medicaid can wait as long as an eligible family member - spouse or a minor child for example, lives in your mom's home. Or perhaps a sibling who lived with and took care of Mom. If the state has not yet required reimbursement maybe the attorney can determine if there has already been a lein placed on the home too. It's necessary to learn why the estate is in limbo so you and siblings can plan accordingly. Let us know what you learn.
I agree that there should be no money left, other than the 2000 and Medicaid maybe entitled to that. My cousin remains in his Moms home because he is disabled. If there is a lean, it has to be satisfied.

If you qualify you can seek the advise of an legal aid attorney if you are unable to afford one. Seems to me that this should have been settled. What do the letters say? I had a client to pass and within 2 months I received the letter regarding a 'lien' of $3000.00 since Medicaid was paying for her nursing home care. Four years seems like a long time to wait.
